Rental Equipment
In exchange for the amounts paid, Touring Tap will provide You with a rental of the Touring Tap mobile beer tap truck (the “Tap Truck”) at Your Event Address on the Event Date during the Event Time. Touring Tap will make best efforts to deliver the Tap Truck at least one (1) hour before the start of the Event Time and will pick up the Tap Truck approximately one (1) hour after the end of the Event Time.
Rental Rate & Deposit Information
In exchange for the use of the Tap Truck, You agree to pay Touring Tap the Rental Cost listed above, plus any Additional Costs which are listed above. One-half (1/2) of the Total Cost is due upon the signing of this Agreement. The remaining amounts due must be paid to Touring Tap by the Final Payment Due Date. Payments may be made through the link provided to You by Touring Tap. Failure to pay the Total Cost by the Final Payment Due Date may result in Touring Tap cancelling this Agreement and keeping any deposits paid to it. No refund will be given for any amounts paid unless Touring Tap is unable to perform under this Agreement.
If You wish to change the Event Time You must contact Touring Tap. Touring Tap may approve or deny a request to change the Event Time in its sole discretion. Should Touring Tap agree to amend or adjust the Event Time an Amendment to the Agreement shall be signed. Should any additional amounts become due because of the change in the Event Time then You shall pay one-half (1/2) of such additional amounts immediately, with the remainder due by the Final Payment Date. No refunds or reductions in the Total Cost will be given because of a reduction in the Event Time.
If Your Event Address is within a twenty five (25) mile radius of the Touring Tap address listed above (the “Included Radius”), Touring Tap will deliver the Tap Truck at no cost to You. Touring Tap will charge an additional Two Dollars ($2.00) for every mile outside of the Included Radius Your Event Address is from the Touring Tap Address (the “Additional Radius”). In the event the Event Address changes from what is listed above, You must inform Touring Tap immediately and an Amendment to the Agreement will be provided, if necessary. If a change in the Event Address causes an increase in the Total Cost, You shall pay one-half (1/2) of such additional amounts immediately, with the remainder due by the Final Payment Date. No cancellation shall be permitted by You due to a change in Total Cost which is otherwise in conformance with this Agreement occurring because of the change in the Event Address. Touring Tap shall be permitted, within two (2) days of receiving Notice of the change in Event Address to cancel this Agreement. If the proposed new Event Address is outside of the Included Radius no amounts shall be refunded to You as a result of the change in the Event Address.
Your Responsibilities
You must supply all beverages you wish to serve using the Tap Truck. If You choose to serve alcohol using the Tap Truck it is Your responsibility to secure any necessary licenses and to comply with any and all applicable laws and regulations. Please make sure any kegs used in the Tap Truck are sixtels or tall ¼ barrel sized, and work with a Sankey-D Coupler. No refunds will be given if the kegs You provide do not meet these criteria. Please contact Touring Tap if you have questions regarding the compatibility of the Tap Truck with your items.
You are required to provide a flat, level area which is at least six feet wide and ten feet long. The location where the Tap Truck will be located at the Event Address must be open and available at least two (2) hours prior to the start of the Event Time and two (2) hours after the end of the Event Time, and an adult must be available to direct and inform Touring Tap where to place the Tap Truck at the Event Address. If the Tap Truck is not available, or You do not permit Touring Tap to remove the Tap Truck, at the end of the Event Time for removal by Touring Tap then You shall pay to Touring Tap a rental rate in the amount of Two Hundred and 00/100 Dollars ($200.00) per hour, plus any other amounts lost to Touring Tap due to any incidental or consequential damages due to the unavailability of the Tap Truck, until the Tap Truck is made available to Touring Tap. All hourly charges shall begin to accrue upon Your refusal or inability to make the Tap Truck available and shall continue to accrue at the start of each subsequent hour. The Tap Truck cannot leave the Event Address without notification to, and the agreement of, Touring Tap. The Tap Truck should only be moved from the position at the Event Address it is placed by Touring Tap in the case of emergency or necessity. YOU CANNOT DRIVE OR OTHERWISE OPERATE ANY PORTION OF THE TAP TRUCK EXCEPT FOR THE TAP SYSTEM.
You are required to keep safe and maintain the Tap Truck in the same or similar condition as it was upon delivery after it is delivered to You. In the event the Tap Truck is stolen or destroyed, or any of the equipment on the Tap Truck malfunctions or otherwise becomes inoperable, please contact Touring Tap as soon as possible. Do not try to repair or fix the Tap Truck without contacting Touring Tap. Should the Tap Truck be stolen, destroyed, or suffer any damages for any reason related to You or Your guests, invitees, employees, contractors, etc., You shall pay to Touring Tap all damages incurred by Touring Tap because of said damages, including the costs of repair, replacement and any consequential or incidental damages due to lost rental amounts from future agreements because of the inoperability of the Tap Truck.
You shall indemnify and hold harmless Touring Tap, and its employees, officers, directors, contractors and members, from any and all damages, claims, costs, including attorney’s fees, or other injuries suffered by reason of any injury or damage to any person or property which is related to this Agreement, unless due to the willful misconduct of Touring Tap or its employees, officers, directors, contractors or members.
